This learning management system is an offer from Murrelektronik GmbH. The company offers the participants online-based learning materials for exclusive personal use. The learning platform can be used with or without registration. Without registration, the learning platform is used as a so-called anonymous user. Without registration, only appropriately published pages can be accessed and read.

Copyrights

With this agreement, you expressly acknowledge that Murrelektronik's service offer contains information, text, software, images, videos, graphics, sound and other materials that are protected by copyright, trademark or patent rights and that the copyrights and exploitation rights belong exclusively to Murrelektronik or its licensors. Depending on the role assigned to you in the learning management system, you can create and make available additional content and information by yourself. However, you may not publish any content for which you do not own the rights of use and exploitation or for which you have received corresponding rights.

Use of information and materials

The right of use of the Murrelektronik service offer hereby granted is not transferable and is granted to you alone. You are entitled to use, display, reformat, download and print the materials available to you through Murrelektronik. This right applies only to personal and non-commercial use.

You undertake not to reproduce, use, sell, transfer, publish or otherwise make available Murrelektronik materials for any other purpose.

If you want to use Murrelektronik materials for purposes other than those listed here, please contact Murrelektronik.

About this agreement

Murrelektronik is entitled to change any section of this agreement at any time. Changes will become effective as soon as Murrelektronik has published them online. If you do not agree to the changes, you must terminate your subscription to the Murrelektronik offer. By your continued use of the Murrelektronik offer, you agree to the amended agreement and are bound by the terms of the amended agreement.

Changes of offer

Murrelektronik may change or suspend parts or certain functions of the offer at any time. Accordingly, Murrelektronik may at any time limit the use of and access to the Murrelektronik offers as well as the duration and scope of use. However, Murrelektronik endeavors to keep downtimes as short as possible and to ensure that all functions are always available.

Fees

Unless otherwise agreed, no further fees are charged for the use of Murrelektronik materials for participants in Murrelektronik training measures.

Registration and account

By using the Murrelektronik offer under the terms of this agreement you assure Murrelektronik that

  • you will not share your username and password with anyone. If any of the user information has been knowingly provided incorrectly or if, when the user data is changed, it is intentionally not corrected, or if you violate these provisions in any way, Murrelektronik has the right to temporarily suspend or terminate your authorization to use the service.
  • You are responsible for any use of the Murrelektronik offer that is made using your user ID and password. You must ensure that your user ID and password are protected against unauthorized use. If you notice or suspect misuse of your user ID and password, you agree to notify Murrelektronik immediately.

User accounts of users who have not logged in for more than 365 days are automatically deactivated. After another 365 days, a deactivated account will be deleted if no request for reactivation of the account is made. A corresponding request can be made by email to knowledgebase@murrelektronik.de. When the user account is deleted, all personal data is also deleted (see the following data protection declaration).

End of right of use

The authorization to use the Murrelektronik learning management system and the right to use Murrelektronik materials expires when you leave the Murrelektronik training courses.

You can terminate your right to use the Murrelektronik offer at any time without giving reasons by informing Murrelektronik of your decision.

Murrelektronik may suspend access to all or part of the Murrelektronik materials or terminate your right to use the Murrelektronik materials if the Murrelektronik materials are used (by you or by anyone else who has access to the KnowledgeBase under your user ID and password) in a way which Murrelektronik considers a violation of this agreement or which otherwise causes damage to Murrelektronik.

Warranty and product liability

Murrelektronik services, information and materials are offered on an "as-is" and "as-available" basis. There is no warranty.

You expressly agree that the use of Murrelektronik materials is at your own risk. Murrelektronik does not guarantee that the program functions will meet the user's requirements or that they will work together in the selection made by the user. Neither the manufacturer nor the developer are liable for any damage resulting from the use of the program.

Notices

Murrelektronik uses email, postings in the Murrelektronik learning platform area or conventional letter post for announcements to you. Announcements by Murrelektronik are valid from the day on which Murrelektronik has made sufficient efforts to reach you. You can reach Murrelektronik as described above. Your notifications to Murrelektronik are valid from the day Murrelektronik receives the notification.

With this privacy policy, Murrelektronik GmbH fulfills its obligation to provide information on the processing of personal data in accordance with Art. 13 of the General Data Protection Regulation (GDPR).

Purpose of the processing of personal data

Personal data is processed in the MyKnowledgeBase learning platform for the following purposes:

  • Digital offerings for training and further education
  • Performance assessment in the context of training and further education
  • Communication and collaboration in the context of training and further education

Legal basis for the processing of personal data

When processing your personal data, the provisions of the EU GDPR and all other applicable data protection laws and regulations are complied with. The legal basis for data processing arises in particular from Art. 6 EU GDPR.

We use your data to initiate business, to fulfill contractual and legal obligations, to implement the contractual relationship, to offer products and services and to strengthen the customer relationship, which may also include analyses for marketing purposes and direct advertising.

Your consent also constitutes a data protection permission regulation. We will inform you about the purposes of data processing and your right of withdrawal. If the consent also relates to the processing of special categories of personal data, we will expressly point this out to you in the consent.

Processing of special categories of personal data within the meaning of Art. 9 (1) EU GDPR only takes place if this is required by law and there is no reason to assume that you have an overriding interest worthy of protection in the exclusion of processing.

Processing of personal data

In order to use the MyKnowledgeBase learning platform, data required for the use of the learning platform and its functions is processed. The following personal data is processed:

  • User account details such as user ID, first name and surname, title, e-mail address
  • for participation in courses and groups, membership, date of enrollment, learning success ("not processed"/"in progress"/"processed"); the respective course tutors or course administrators are technically responsible for the files provided within the courses
  • Date of registration, ownership of objects when using the internal mail system, messages sent and received via the e-mail function
  • Consent to the terms of use and date of consent
  • the authorizations (roles) with which the user account is provided
  • Server logs containing the name of the accessed file/page, date and time of access, amount of data transferred, http status code, accessing IP address and browser type/version

Recipients or categories of recipients of the personal data

The learning platform and the personal data are operated and stored on Murrelektronik IT systems. If external technical service providers are given access to personal data in the learning platform, this is done on the basis of an order processing contract with the service provider.

Transmission of personal data

We will only pass on your data to third parties within the framework of the statutory provisions, with the corresponding consent, or if we have an overriding legitimate interest. Otherwise, your data will not be passed on to third parties unless we are obliged to do so due to mandatory legal provisions (passing on to external bodies, such as supervisory authorities or law enforcement agencies).

Duration of data storage and deletion

We store your data for as long as it is required for the respective processing purpose. Please note that numerous retention periods mean that data must continue to be stored. This applies in particular to statutory retention obligations (e.g. from the German Commercial Code or the German Fiscal Code, etc.). If there are no further retention obligations, the data will be deleted once the purpose has been achieved.

In addition, we may retain data if you have given us your permission to do so or if legal disputes arise and we use evidence within the framework of statutory limitation periods, which can be up to thirty years; the regular limitation period is three years.

The user account is deleted or anonymized when the identifier is deactivated. All usage and history data of the person will also be deleted or anonymized.

Rights of affected parties

First of all, we would like to inform you here about your rights as an affected party. These rights are standardized in Art. 15 - 22 EU GDPR. This includes:

  • The right to information (Art. 15 EU GDPR),
  • The right to erasure (Art. 17 EU GDPR),
  • The right to rectification (Art. 16 EU GDPR),
  • The right to data portability (Art. 20 EU GDPR),
  • The right to restrict data processing (Art. 18 EU GDPR),
